The subject for discussion at this roundtable will be the recent ruling in the DSG (Dixons) case and its implications for transfer pricing in the UK and elsewhere. Murray Clayton and Pim Fris will lead the discussion, focusing on legal and economic issues respectively.
Points to be discussed may include:
- the definition of a provision under Schedule 28AA
- comparability analysis and its role in transfer pricing analyses
- the importance of relative bargaining strengths and other factors in determining comparability
- comparability adjustments v. profit split methods
- what the case reveals about HMRC's approach to transfer pricing
- how the case relates to OECD developments
- contrast to Glaxo Canada and other cases
- outlook for transfer pricing in the UK and globally
